This policy explains what data miDeclaro processes, why, where it is stored, and what rights you have over it.

What we process
Identity: name, NIE or NIF, country of tax residence. Tax data: the type and amount of your Spanish-source income, property details (address, cadastral reference and value, dates, ownership share), and any tax withheld. Documents you upload: nota simple, IBI receipt, deed, bank certificates. Your conversation with the assistant, so a half-finished declaration can be resumed and for quality control.
What we use it for
Solely to calculate your non-resident income tax, generate the official forms (Modelo 210, 211, 213) and keep them in your archive. We do not sell your data or pass it to third parties for commercial purposes.
Legal basis
Performance of the contract you enter by using the service (art. 6(1)(b) GDPR). Subsequent retention rests on a legal obligation (art. 6(1)(c) GDPR).
Where it is stored
All data is processed and stored inside the European Union. The database is in the European multi-region (Belgium and the Netherlands) and processing runs in Belgium. AI analysis also runs inside the European Union. No data is transferred outside the European Economic Area.
How long we keep it
Filed declarations are kept for at least five years, under article 66 of the Spanish General Tax Law, which is the limitation period during which the tax authority may require them. Conversations that never result in a filed declaration are deleted after twelve months.
Your rights
You may request access, rectification, erasure, portability, restriction or objection by writing to yusef@mideclaro.com. Erasure does not extend to declarations already filed for as long as the legal retention obligation lasts. You may also complain to the Spanish Data Protection Agency (aepd.es).
